Threshold Criteria

You are expected to have held an interest in a main business in Australia for a minimum of 18 months immediately before the date of application. The threshold requirements for the EBA visa are:

12 months before an application for an EBA visa, you must have the following:

a) you must have a minimum 10% interest in a business in Australia.

b) assets in Australia to the value of $250,000 of which $100,000 must be in the form of net assets in the business for the full 12-month period.

c) 9 months cumulative residence in Australia.

Once you comply with the above requirements, you must, at the time of application, obtain at least 105 points for the various factors in the EBA points test, including business attributes, age, language, net assets.

Established Business in Australia Points Test

Throughout the 12 months before application, you must have:

• employed at least 3 full-time Australian permanent residents or citizens (excluding you or your spouse); and
• had either sales turnover of AUD$200,000 per annum OR exports of AUD$100,000 per annum

You are eligible to receive 60 points if your business meets these business attributes.
