Do I need to advise the Department of Immigration if I change my address?
You must notify the Department of Immigration and Citizenship where you intend to live while your application is being processed. If you will be changing your address for more than 14 days you must tell the Department your new address and how long you intend to be there.

SPONSORSHIP QUESTIONS - often asked by Australian companies seeking to sponsor overseas business entrants

How do I know if a person is entitled to work in Australia?
If the prospective employee is not an Australian or New Zealand citizen, then you need to check his/her visa to establish if that person has work rights. There are three visa features you need to consider:

1. Period of stay - indicates the length of time a person will remain lawfully in Australia.

2. Conditions - some visas indicate that there are work related visa conditions

3. Status - if the person has a valid visa, the status of the person in Australia is lawful

Can I employ someone who has a Subclass 456 visa?
The Business Short Stay (Subclass 456) visa is generally not intended for persons seeking to engage in paid employment in Australia, except where paid employment is related to a high skilled occupation where an Australian citizen or permanent resident is unable to undertake.

What visa does my overseas business contact need to come to Australia for a meeting?
The Business Short Stay (Subclass 456) visa. This visa allows the holder to travel to and remain in Australia for up to three months on each visit. It is also the appropriate visa for persons coming to Australia for business negotiations, contract signing, site inspection, investment exploratory visits, etc.

What is a Business ETA?
The Business Electronic Travel Authority is an electronic version of the Business Short Stay (Subclass 456) visa. The ETA can be issued by travel agents and major international airlines to citizens of many countries.

Can I employ someone from overseas on a temporary basis?
You can employ someone from overseas if you can satisfy the Department of Immigration and Citizenship that you are qualified as a sponsor. The person you want to employ should apply for a Business (Long Stay) visa (Subclass 457). Click here for more information.

Can I employ someone from overseas on a permanent basis?
You may nominate that person to migrate to Australia or remain permanently under the Employer Nomination Scheme. This visa is intended for positions requiring highly skilled personnel and you are able to demonstrate that you are unable to fill the position locally. Click here for more information.
