There are 3 processing stages for Business Long Stay visa applications - Sponsorship, Nomination and Visa.
SPONSORSHIP APPLICATION REQUIREMENTS:
To sponsor an applicant for Temporary Residence,
the employer must:
- be lawfully operating in Australia
- actively engage in business activities
- be the direct employer of the visa applicant
- be able to comply with sponsorship undertakings (financial obligations
to the Australian Government in terms of taxation, superannuation
and other employment conditions but also extends to other cost associated
with the visa applicant such as medical expenses, repatriation costs
if required)
- notify the Australian Government regarding any changed circumstances
in the job or the employee's situation
- prove that it is committed to training Australians or be involved
in the introduction of new skills or technology into Australia
- prove that employing overseas staff in its business is of benefit
to the Australian economy.
NOMINATION APPLICATION REQUIREMENTS:
Minimum Skills Threshold
A minimum skill level applies to all positions to be filled by overseas employees. The employer can only nominate occupations listed in the gazette notice at the time of application. The skill level of the nominated activity must correspond with the skill level of the occupation specified in the gazette notice.
Minimum Salary Threshold
The nominated position must be remunerated at a level not less than
a minimum salary level specified by the Australian Government. This
is currently set at A$57,300 for positions in Information and Communications
Technology occupations and A$41,850 for all other occupations. The minimum
salary level should exclude other non-salary benefits such as accommodation,
car allowance, bonus, commissions, health insurance, communications
packages, living-away-from-home-allowance, shares, superannuation contributions,
etc.
VISA APPLICATION REQUIREMENTS:
The visa applicant must have skills and qualifications that match the skill level of the nominated activity. The applicant must also meet the health and character requirements.

Overseas Employer
For employers who do not already operate a business in Australia. The
staff member seeking a visa must either:
- be involved with the establishment of a business in Australia with
overseas connections (such as a branch office of their employer's
business), or
- be sent to Australia to fulfil a contract on behalf of their employer
